West Virginia's Motion To Dismiss Big East Suit Denied In Rhode Island Court

Judge Michael Silverstein denied West Virginia's motion to dismiss the Big East lawsuit against the school in Rhode Island Superior Court today (click here to see the document laying out the decision).

Silverstein concluded:

After due consideration, this Court denies Defendant‟s motion to dismiss on all grounds.
This Court finds personal jurisdiction over WVU and sufficient service of process. Further, this
Court declines to dismiss the Plaintiff‟s Complaint on the basis of comity or the doctrine of
forum non conveniens. Prevailing counsel may present an Order consistent herewith which shall
be settled after due notice to counsel of record.

Before the decision became known, the Big East reiterated their intention to keep West Virginia as well as Syracuse and Pittsburgh in the conference for the duration of the 27-month exit period. The conference also stated that it would not accept a buyout from the schools.
